Claiming the deposit vs section 21 or section 8

Hello to all, i need to ask a tenant to move out (he grew mould at the property because of heavily increasing condensation, which he denies) and I will try to claim his deposit to cover part of the redecoration and mould cleaning costs. I wonder if in this case it’s better to serve a section 21 (to possibly support the claim? ) or (to avoid paperwork) just ask him to move out and hope he will understand. Also, maybe section 8 is appropriate in this case? Would it help to back up the deposit clame or do they have nothing to do with each other?

I think you may be be in for a bit of a shock. You should read some of the recent Government pronouncements and documents on mould in rental properties, the headline of which was that mould is not caused by tenant lifestyle. You are almost certainly going to have to get a professional damp assessment to identify the cause and to show that you are tackling the issue through advice to the tenant and any structural changes identified if you are going to persuade a judge to evict your tenant.

Thank you David. I did have 3 inspections including measuring humidity of the walls and all of them confirmed the reason of the problem is condensation. I’ve had this property for more than a decade (almost always rented) and this is the first time the mould appears. I decided to explain the issue to the tenant and try to have him move out without serving the notice right away.
