Court possession

Yes I think that is increasingly true - you can’t use the electronic portal for accelerate possession - and so called accelerated possession now seems to be as slow or as slower as having a court hearing. I have used it recently and now wish I had not.
the old wisdom that it is best to use a section 21 and accelerated possession to get the tenant out quicker now seems not to apply . I will rely on section 8 wherever i can in the future as where I have used it it seems faster.
There seem to be a lot of individuals in the courts and in local councils who simply see section 21 notices as unfair “no fault evictions” these days and do nothing to accelerate them.

The tenants are only paying £1250 pcm rent. As such I am losing £100 a month that new tenants were happy to pay. I am tempted to issue a sect 8 Claim 3A alongside the N5B accelerated possession, and include the numerous breaches of contract. If nothing else it will cripple them financially.

The shortage of property and the extreme level of demand amongst tenants means that there will always be someone desperate enough to pay another £100 a month. That doesn’t mean that the property is worth that or that the tenants are parasites. I would suggest a little more humility and respect for tenants.

For me the worst part of the job is knowing and seeing how it affects peoples lives. IE having to say no to desperate people. It’s such a responsibility. I have on occasion considered using an agent to just keep some level of separation.

I can assure you the property is very much worth the increase of £100.
And as for respect and humility it works both ways. I am not running a charity if you can’t afford the increased rent then move and find somewhere within your means.
Don’t stay and run up debts and blame your landlord.

I am not in least bothered about your opinions. This one property is my pension.The longer it takes to get them out the more arrears and debts they are incurring for themselves. No one was holding a gun to their heads to accept an increase.

You are a liar, and i need to defend these false aligations. I have not moved in my other 2 children, they live full time with their mum and come for daily visits. You were fully aware that 3 of us would be moving in as stated in my open rent messages to you enquiring about the property. Also my partner was present when we came to veiwing. I queried the contract you gave me as i was the only person on their and said there would be 3 of us living there and you messaged me that was ok and i didnt have to have them on the contract. You have been aggressive, abusive, threatening and we have caught you letting yourself in our property without our knowledge or consent on our ring door bell. You have threatened to keep our deposit only one week of serving section 21 notice and not giving us a reference or giving us a bad one if we didnt leave within 14 days. You have continued to harass us to move out and spread lies about us, threatening to film us on facebook being evicted. Called us names, saying we are poor and you will financially ruin us. We have paid all our rent to date and have not damaged the propery that you keep accusing us of, even the police notified you there was no damage. We asked you for a long term rent of a minimum of 3 years as we gave our furniture away because the property was fully furnished and only after 6 months you offered only another 6 months with a rent increase. You spread lies that im agressive and threatening, show the messages here, you have none because i have only ever been courteous and paid our rent and tried to live in the property undisturbed, in peace and quiet that been impossible with you the last 3 months. Im fed up with all your lies, slander and accusations and now i am standing up for myself and my family. I have paid all my rent and have asked you to follow the legal process and leave us alone, your constant threats of court, bailiffs and financially crippling me needs to be exposed. If you havent behaved in such a manic and aggressive way and helped us move on instead of threatening to keep our deposit we could of found somewhere sooner. You are not fit to be a landlord.

@David125 I would suggest you speak to a solicitor about the harassment you feel you’ve experienced as this may be quite important for you later. I’m sorry you’ve had such a poor experience of renting. There are better landlords out there.

I suggest you are both careful with your words on public forums like this.
If you have a complaint share it with you legal adviser. … anything else you unguardedly say here may harm you respective cases .

As a landlord I may share my my experiences here to ask for advice or to share knowledge with others both landlords and tenants - but it isn’t really the place to vent or share details of current cases - everything can be printed out and used by the other party! Including labelling tenants parasites etc
This forum can be read by both landlords and tenants. Both partners in the agreements we forge to provide and occupy homes have rights and responsibilities and this should not be a partisan place.

But ultimately you can’t settle your dispute here. Either talk to each other and sort it out or go through the courts (landlord) or make a formal complaint about you issue (tenants). Rowing here will just weaken your case if you feel you have to resort to that !

Thank you all very good advice which I decided to act upon.

I served David notice in Sept for no other reason other than he declined a £50 pcm increase, he was adamant he couldn’t afford the increase as his fixed term was ending I assumed he would prefer to find a cheaper rental.

David saw this as an opportunity to use the possession order process in order to queue Jump our local councils social housing queue.

He denied receiving form 6a and I have not been contacted or asked to supply any references.

Being the bigger person and giving David the benefit of the doubt I sent David this text message on Sunday afternoon

“I am offering you the opportunity to leave with a good reference and return your deposit in order for you to move on.
It is clear there is no mutual trust and we cannot work together. “

David has not responded,
but the offer was there…

Now on a rolling contract, I served David a form 4 rent increase of £150 pcm the true market value which takes effect from January.

If David wants to pay me £1400 pcm
that’s his choice. I have no plans to sell the property and therefore have decided not to move forward with a possession order, let’s just see what the next rent increase brings :woman_shrugging:
