Does a USA tenant with a visa need a “Right to Rent “

We have a prospective USA Tenant. Do they need to apply for a Right to Rent , which I understand you have to obtain from the home office

@Basil5

No. You have to ask them if they have a right to rent by asking them for their HO share code or checking their docs

They don’t ‘apply for a right to rent’. They either have it based on their visa/immigration status or they don’t. For example an ETA to travel to the uk would give a us national a time limited 6months right to rent.

For the prospective tenant

For you once you get the share code from the tenant

And the full guidance

Good luck

Nearly right, but the “check their docs” option isn’t there for a visa holder. Anyone granted a visa now gets an eVisa, and the Home Office guide says eVisa holders can only prove right to rent through the online service. So get the share code and their date of birth, run it on gov.uk and save the profile page it gives you. Looking at the passport gets you no statutory excuse (but might be needed for ID verification).

The only exception is if they’ve just landed on the 90 day visa sticker and haven’t set up their UKVI account yet. You can check the sticker by hand, but you’d have to redo it with a share code before it runs out.

The online check works over a video call as well, so you don’t have to meet them.
