I would appreciate a steer on tenancy contract if anyone can advise. I have a 1 bed contained annex that is separate to my main dwelling but has the same address and is therefore not considered an independent dwelling, even though it technically is. This appears to be an issue re OpenRent providing a contract as they say this dwelling does not meet the requirements of an AST but the more risky Lodgers Tenecy contract which I feel is risky because of the following:-

The deposit does not need to be protected in a government scheme.
Repossession will usually start by serving a notice to quit instead of a Section 21 or Section 8 notice - this is what I’m most worried about.
The tenant fee ban does not apply.
I have tenants that have paid holding deposit and passed all referencing checks. Not sure which contract exists to protect me in this situation. Can anyone offer advice?
As the annex is separate to your home, then I agree that it is not wise to rely on a non housing act tenancy. Schedule 1 of the Housing Act 1988 defines a resident landlord as either sharing their own living accommodation or living in a separate part of the same converted building.
Thank you for advice. I’ve tried to ask openRent to move forward with AST but because my Landlord address is same as the annex address I’m automatically prevented from accessing AST contract. Not sure how to move this forward and don’t want to lose tenent.
