So after 4 years of having a great tenant, I’m advertising again. It seems the housing crisis has gotten worse and I’m now getting approaches from adults and their parents (for ref its an 2 bed flat but second bedroom is a small single) I’ve listed as 2 tenants for the tenancy, however if there are 3 adults potentially living there my gut feeling is all three should be on the tenancy.
are they def all family members? 3 adults in some local authorities constitutes an HMO so you’d need to have proof that they are actually related before letting to them if that’s a concern.
My advice is all occupants should be named on the tenancy agreement.
Consider following possible scenario.
John, Ann and Peter move in. John & Ann are named on the AST. After 1 year John & Ann give you notice to terminate.
Peter remains and refuses to move out. How will you oblidge Peter to pay rent & bills? What will be the rent amount? If you do not agree with Peter, how will you regain possession?
Definitely have all occupants named. Whether all 3 are named as responsible for paying the rent is up to you and them to agree but worth referencing all 3 anyway
3 tenants = more wear n tear than 2 tenants just like if tenants have pets (or small children). So you may want to charge more if 3 adults want to rent it just like you could charge a couple more than a single. The amount you advertise at doesn’t have to be exactly the same as the amount you /they agree esp if you get multiple offers/interest (amend listing with agreed amount just before they put down the holding deposit )
3 tenants = better affordability /more incomes, potentially (but might be better to have a couple with 2 earners than 3 adults where one is a student with no earnings)
If your preference is for 1-2 adults only based on the size/space available say ‘Suits 1-2 adults’ in advert (legally you can’t say no pets etc in advert but it’s up to you whom you rent to)
