The last line of this paragraph says it all, notice doesnt apply until you move in. Tenancy agreements normally start from a specific date ie moving in date, anything prior to this only entitles the landlord to keep a holding deposit which in England is equivalent to one weeks rent. The joys of being a landlord I am afraid.

I’m not sure that can be right, the CONTRACT part of the tenancy agreement is just that, a contractural obligation, we have foreign students for whom their HOUSING law tenancy agreement only starts on production of their passport but they still have a financial commitment.Essentially what’s being requested is the surrender of that contract, surely provided for in the AST as an “on request” concession on the proviso of financial obligation continuing until new tenants are sourced?
The deposit is bonded sojustgothroughthe dispute process claiming the largest reasonable sum for costs and loss of income. Its really that simple. Hope you have keys back and written confirmation of them breaking contract. Dont give deposit back voluntarily
