Tenant moving new partner in

My tenant has been in the property for 6 months now and wishes to extend his tenancy, which I’m ok with - under the new rules do I reissue a new 6/12 month agreement or does it just roll on now month to month?

Also he asked if it was ok if in the near future if his new girlfriend moved in with him. But asked does she need to go on the tenancy agreement? He will still be the one paying the rent.

Are you in England? If so, no such thing as a fixed 6/12 month tenancy anymore so it doesn’t get ‘extended’- if you try issuing one you’ll be liable for a £7,000 fine. From 1 may in england all ASTs turned into APT rolling tenancies. If you didn’t issue the RRA info sheet by 31 may you are also liable for another £7,000 fine.

You can add her as a permitted occupier or have a new tenancy with her as a tenant too in which case she’d be jointly liable for the rent

Suggest you consider getting some LL training.

Good luck

I wouldn’t recommend adding her as a tenant at this point. Relationships can end and your tenant could easily lose his home if his girlfriend has equal tenancy rights. Just don’t accept any rent from her.

Whichever way you do it, check her right to rent before she moves in. It covers every adult living there as their main home, named on the agreement or not, and once you’ve said yes she’s there with your permission. The Home Office guide from 1 October reads as though you check all the adults when a new one is added, so him again as well. If they’re both British that’s a passport each and a dated copy for your file.

The information sheet deadline was 31 May, not July. If yours never went out, send it today.
