Tenant not left despite giving notice to

My tenant served notice that they were leaving. The date they were due to leave (tenancy ended) has passed but the tenant has now said the place he was moving to has fallen through. I have already rented the room out and signed a contract with a new tenant so need him gone in the next week. What can I do?

Big mistake to do so without a vacant place. You can do nothing immediate save tell the incoming tenant that you are sorry and pay compensation

If the tenants notice was valid, (check this) then they are now a trespasser. Dont accept rent from them as this may start a new tenancy. You can immediately apply for a court order to end their occupation. Under the Distress for Rent Act, you can also impose a daily charge of double the former rent, although you need to be careful how you demand this as it has to be paid retrospectively.

David is right. Don’t accept rent. Don’t give them permission to remain “for a period”. Your communications with them would be: “you have no lease and are trespassing”.

Then seek legal remedy immediately.

Did they serve notice in the way prescribed by the contract?
