Tenant won’t give up tenancy

Hello all, my tenant left the property without telling me and has stopped paying. His tenancy does not expire until 30/11/2025 but he has said he has not abandoned the tenancy and property which is a lie. He has made no attempt to talk to me on phone but want to chat via text only. He has made no attempt to pay the rent and rent arrears . I have submitted a Section 8 notice and I am in the process of completing the Possession Claim form online but the claim says I need his address he is living at right now which he is not giving me. This has stopped me from completing the form . Can anyone help or advise me here

He left my rental and is living elsewhere but won’t give me his new address. The court form asks for his current living address . Hope that makes sense

If he hasn’t returned keys to you then his current address is the property where he has a tenancy, no? After all, he himself says he has not abandoned the property or tenancy.

This just seems logical to me, but it may be codswallop as I’ve never had to file a S8 or possession claim so others will advise better than me.

If he has a contract with you and he says he is living there it is his current address you can serve notice there

His contract expires on 31/11/2025, if I don’t use the costs of courts which can take up to 4 to 6 weeks to sort plus £404 cost . Would it be easier and cheaper to wait until his contract is due to expire and not renew it ? What are your thoughts ??

My advice to you is get a solicitor

You are dealing with a malicious tenant and you need to be ten steps ahead of it. I’m experienced and I’m taking legal advice because I know I’m in a trap that is one I am aware of but have not dealt with.

He has told you he’s living at the house his stuff is there

You can pay landlord action for a fixed fee .

I have used multiple avenues to eliminate abandonment. You have it in writing it’s not abandoned . So use his current address.

Why aren’t you using s21?

If the contract expires at the end of November it’s too early

This is the first time I have done this . Section 8 is used for rent arrears and reclaiming the property. From my understanding of section 21 is that I would still have to go to court to regain the property. But at least with section 8 I can possibly claim tenant arrears and any extra costs …is this true or have I got it wrong ???

I am getting legal support, I know my section 8 notice is correct and I will be going on line today to place my claim on possession claim portal. It is all straight forward and the process has been explained to me by a legal support team who do this work pro bono. I just need to represent myself and I have printed out all my messges between myself and this tenant ready for court

With due respect, in the legal profession there is a saying

Only a fool would represent himself

I am currently in a situation and I took counsel. I was advised not to represent myself as it was a fool’s game to do so by a lawyer who’s representing me without remuneration.

RRB is around the corner . This is not the time to take risks .

er… but it won’t expire. The terms of the contract which you signed will say that it becomes a periodic contract. A tenancy ain’t over until it’s over… and even then…

What is RRB meaning ? Also I cannot pay an outright fee of £1200 for council
