The financial remedy for deposit breaches is not compensation, its a statutory penalty. Its also a strict liability offence, so if the breach is proven, the judge has no discretion over whether to make an award. They have to impose a penalty of between 1x and 3x the deposit.

I wasn’t sure what the speculation about anybody’s emotions was for. It didn’t seem to be advice based on any of the facts presented. But we were apparently commenting at cross purposes.

David168 was cautioning a T from pursuing what is their legal right by saying future LLs might not respond well to a T who did so. I was responding by saying no one should be fearful of pursuing what is theirs by rights and that decent LLs should have nothing to fear from Ts who are willing to do so.
