Adding a name to existing tenancy

Hi

Can I add my partner name to an existing tenancy as a landlord (still leave my name on as well)

For mortgage reasons - some in joint names, some in mine & some in hers

I think you can use a deed of variation to amend the agreement with the consent of the tenant, but a simpler mechanism might be to serve the tenant with a s3/s48 notice with the names and addresses of the new landlords.

If you have a Openrent tenancy agreement, and if it’s beyond minimum term, you may wish to issue a new AST to the tenant which you can do via OR portal for free, and my understanding is you can add a co-signatory as part of the editing of the contract before sending…. I say this, but have never done this, so cant be sure.

Do this before RRA comes in to avoid the added complications.

Bear in mind if you issue a new AST the clock starts again, and you cant evict for some reasons for 12 months.

I wouldnt recommend this as Brogue1 would lose some of the benefits of an existing tenancy, such as the clock re-starting on serving a ground 1A notice.
