Allergies are a disability

On Wednesday the Times published this article. Allergies are considered a disability and therefore landlords with allergies do have rights not to have pets , technically ….

@A_Z

and you trust The Times to be accurate? Have they quoted actual caselaw that’s already been tested considering tenants rights under RRA or is this just speculation (sorry can’t see article)

Anyway that’s not what’s in the RRA guidance on pets which says if a fellow tenant has allergies that’s a consideration. The guidance does not say LL with allergies have any excuse

-after all as @David122 has pointed out, LLs can simply employ others to do inspections any repairs etc. Even if LL was employee of a Ltd co which was the LL, the Ltd Co can employ someone else to go in.

I guess if a property is remote and there really is no option for others to inspect it might be reasonable.

We just don’t know what is going to be considered a reasonable refusal or not till courts rule in some cases

Every case has to be considered individually tho, you definitely can’t use blanket bans on pets.

Best

Thats very unlikely to be the case. Landlords would be expected to use third parties to carry out inspections, check-outs etc. I would not advise any landlord to rely on such a defence.
