I have just got a new tenant with a contract running on the 19th of the month. They would like to move thier payment date to the 29th of the month so this aligns with thier pay day (they are in thier first job from uni so currently have no savings and thier first pay check comes next month).
Can I just asked them to pay 6 weeks on the 29th of next month (to cover the 2 weeks from the previous month that has not been covered) then pay on the 29th of each month u til the end of the contract where they will just pay 2 weeks (29th - 19th?)
Do I need to add an amendment to the contract for this?
Personally, at this stage, I would just allow them to pay the standard rent 10 days late each month. I feel this will be less complicated in the long run.
This problem should have been foreseen by Landlord and/or tenant before the contact was issued / signed. It is a fairly common situation for people to be paid at month end. Try & have this conversation with new tenants in the future to check they have the funds.
However, if the guy doesn’t have money to cover rent for the first month, why did you sign a contract/let him move in and how likely is it that he will have spare cash for another two weeks?
If the tenancy agreement is already running, then there is no reason why the tenant cannot pay on the 29th of each month but they should not assume the resolution is to pay late. So they should pay:-
19th August - to cover the payment due on the 19th of August
29th August - to cover the payment on 19th September
29th September - to cover the payment on 19th October
and so on…
If they haven’t got the money to pay a week before their pay date, they are very unlikely to have the money to then convert to paying 3 weeks early, by paying 2 rent payments in one month
Ah right, I misunderstood the issue. I thought the issue was their rent payment is due on the 19th and they wanted to pay on the 29th but it sounds as if, they get paid on the 29th, by the 19th of the month they are struggling to pay their rent so they want to skip a month. In my view that will be the start of a creep to pay later and later. This sounds like an issue the tenant needs to address not the landlord.
