My tenant has left my property with damages estimated at £2600. The agent is taking my case to DPS but the tenant is disputing the amounts. Deposit us only £685
Now the agent says i have to declare if im going to small claims or not before they submit to DPS. Why do i have to state this as im undecided ?
Any advice welcome please
Small claims doesn’t cost a lot, definitely worth doing for that sum of money, providing you are being realistic.
The reason is that if you go ahead with the deposit claim, it will effectively rule out any small claims court claim for the same debt. Before deciding, you should review the costs youve been quoted and read more about what youre allowed to claim. Its common for the schemes to reduce claims substantially to allow for wear and tear and the age of the item.
