Mutual Break Clause - Termination of contract

Hello there,

My initial term of the contract (12 Months) was signed in Oct’23 and it expires in Oct’24. I have a 6 months break-in clause too in my contract. I’m into my 8th month of the contract as of today. I have found a new property and was thinking to go for it. Can someone suggest whether I have to give landlord with 2 months notice (or) 1 month?

I have the below clause in my contract:

Mutual Break Clause
12.6. The Initial Term of this tenancy agreement may be terminated by either party giving the other at least two months’ notice in writing, such notice not to expire until at least 6 months after the start of the Term. A notice served by the Landlord under section 21 of the Housing Act 1988 shall be sufficient notice under this clause.

The Tenant is obliged to pay rent up to and including the termination date, so if the tenancy is terminated on a date which is not the last day of a rental period, the rent due for any incomplete rental periods will be apportioned accordingly.

You have to give 2 mlnghs notice and it would make sense to do that on the last day of a tenancy period as you’d be paying extra rent if you do it on any other day.
