My tenant who is just over a month into his tenancy and from kenya wants his partner and child to live with him in the property she is also from kenya.
He has a good job here and i guess will support her and his child and has been working here for a while and passed referencing, however she will not have any history in this country so will probably not pass any checks although she does have the right to rent for a couple of years. so my question is what would be the best course of action.
Provided that the property is adequately sized for the three of them and the partner has the Right To Rent I would grant permission for the partner and child to be added to the tenancy as Permitted Occupiers.
I wouldn’t. Better to sign a new contract with both listed. If someone is living there, in my view they should be liable .
Liable for what? If the partner has no income then not worth pursuing for payment. In my view, permitted occupier is just fine. They are obliged to leave when the tenant leaves.
Leave the tenancy as is. Is she a wife or partner?
If a wife she has spousal privilege.
If a partner I would get legal clarification.
I would not add a third party into the tenancy now as it would mean a lot of paperwork. I would accept it as a permitted occupier and do right to rent checks and notify your insurers of occupancy as its now a family not a single person.
So why didnt she move with him in the 1st place did they live together (with THEIR child) before regardless of where they are from. Even if it was an English couple who were doing this it strikes me as sus that after 1 month they decide that they want to live together.
Id personally be very sceptical do as many checks as tou can make sure she is documented on the tenancy id even go as far as asking to see proof of marriage (whats to say he hasnt got the house as he has “a good job” for her and will “leave” her after a few months leaving YOU with an unknown tenant who cant pay
As i always caveat with I AM NOT A LL and may be totally wrong but i would do all due dilligence checks on her and make sure she is named also

It is quite normal for internationals to come over after securing a job . They find a property and bring their family over once they have secured tenure.
They would not be able to bring over the partner at the same time, if they did not have a job too .
Ah ok you didnt mention that she was coming over from Kenya i wrongly assumed she was already living over here
I would still double check her visa etc and what permissions she has
You need to see proof of marriage to ascertain if she is actually the spouse of tenant. This will determine what rights she’ll have even as permitted occupier (which you should make her and also inform insurance/mortgage companies).
