New tenant agreements

Hello!

I will soon let to a tenant (privately found) but they are concerned that by initiating the process of getting shortlisting and tenancy agreements, their current landlord (also on OpenRent) will find out / be informed by the platform. Is anybody able to confirm that this is not the case?

Seems unlikely just because of GDpR alone

You do realise GDPR is the EU directive and not the law. In the UK we are compelled to comply with the newest Data Protection Act (2018) and any changes to it by enabling legislation that our parliament dictates.

Also the legislation makes a case for allowing provision of personal data if it’s proportionate for the purpose for which it is intended.

The proper reply is to ask the OP why and on what basis there is a concern about provision of information.

The UK GDPR became law in Jan 2021. The UK retained it’s own version of the law after Brexit…

If the new tenant goes though open rents referencing this would include a landlords reference which would notify them. I would have thought there must be a way of saying not to contact existing landlord until everything else is accepted but if not dont give existing landlord details at first stage. Existing LL wouldn’t be notified automatically.

And I agree, there should be a way to progress a tenancy application without informing current landlords.
