RRA Limited Contract

Will it be possible to let specifically for one year only under new RRA. I don’t want to be caught in second home traps whilst my place is empty. I want it back after 12 months for a relation.

Fixed term contracts will be scrapped under the RRA.

here’s the deal under the RRA for new tenancies:

Ground 1 - occupation by landlord or family

If you or a close family member need to move into the property, you will be able to use this ground.

You will not be able to ask your tenant to leave for this reason within the first 12 months of a new tenancy.

Ground 1 notice period

You will need to give 4 months’ notice before going to court to apply for a possession order to evict your tenant. You or a close family member can only move into your property after evicting your tenant.

This means that you have absolutely no way of being able to predict with certainty that you will have it back when you want it. The best you can do is to give notice at 8 months in and hope they leave at 12 months. If they do not, you then go to court and that could take who knows how long at that point. Typically up to 18 months currently.

The only way you will defo. get it in 12 months is if you do not rent it out

No. Fixed terms are abolished under RRA. If you have terms in a contract specifying 12m and try to enforce it you will face a large fine.

Can you understand why many LLs here say they are selling up?
