@David122 The tenant is required to pay the deposit and the first month’s rent to OpenRent in accordance with the terms of the standard OpenRent AST. OpenRent will then register the deposit and pass the first month’s rent to the landlord once the tenant has moved in. If the tenant fails to pay the deposit and the first month’s rent in accordance with the OpenRent standard AST then yes they will be in breach of the contract.
@Dan4, thank you for that confirmation. I’m sure that will be reassuring to anyone else in a similar position. Is it your view that failure to pay the deposit would be sufficient for the contract not to be made and for it to be legitimate for the landlord to deny the tenant access to the property to begin the tenancy?
Of the tenant paid a months rent and they don’t have they keys the tenancy has started

I would be keeping the rent paid also as you have lost potential rent due to their fault.
