Hello, we passed the year that my tenants had a contract for. Is this something I should rectify immediately or will be automatically be a rolling contract.
What does the contract you’re referring to say? It should be somewhere near the start where you might find it talks about the “fixed term” or something like that.
It will now be a Periodic Tenancy under the same terms as the original. If you tenancy agreement stated this would happen its a Contractual Periodic Tenancy if it didn’t its a Statutory Periodic Tenancy. There are minor differences but you don’t need to do anything.
If it’s a Statutory periodic tenancy, I’m sure you are suppose to re-serve the current Right to Rent Guide. This is not necessary for a Contractual Periodic Tenancy.
If you view it as a new tenancy, and there are conflicting views on this, then you should re-serve ALL the prescribed information again in order to be able to serve a S21. Probably best to do this regardless as then you are definitely covered!

most Landlords will allow to go periodic. More flexible for both parties.
Its better for you to let the tenancy remain periodic.

I would just let it roll on from now if its already periodic.
My tenecy agreement ran out September 2023, luckily I noticed I asked my landlord he said not to worry it’s on going. Now I’m not 100% clued up on tenancy agreements or much to do with renting property but I am starting to learn. I was worried my universal credit housing element payments would stop as they have a copy of the tenancy agreement. But nope universal credit are still paying monthly so I gather he is correct, it didn’t really doubt that Anyway as he would definitely not jepordise his rent.
