Hello, a straightforward question here I think. My tenant is at the end of his one year tenancy. Should I ask him to renew for another year in a contract or let it roll as he would still be legally obliged with a rolling non contract??
Thank you, Louise
Easy. Let it become a periodic tenancy. Better for both of you.
Most private LLs prefer to let it roll on because you don’t need to do all the admin associated with a new tenancy. Additionally both the LL and tenant are not locked in for another lengthy fixed term so if circumstances change LL can end tenancy with 2 months notice and tenant can end it with 1 months notice. You can also increase the rent without creating a new tenancy.
So this would just entail emailing the Tennant and suggesting this, then not doing anything? Presumably he would be covered by existing contractual agreements if I let it roll.
You have to read the tenancy agreement. Some state what happens if the tenancy is allowed to become periodic and some will be silent in which case it becomes a statutory periodic.
