I am on a periodic joint tenancy now, haven’t lived in the place for months, served notice to quit the joint tenancy but the agent says I don’t know the law and the tenancy won’t end until my housemate leaves.
Should I just not pay and disappear? They didn’t answer my notice to quit email nor me asking to confirm t hey have read it. What would happen to my grantor if I don’t pay them anymore? Thanks

I cant remeber all the detail of your case, but it sounds as though your agent is wrong. One tenant can serve a valid notice to quit during a periodic tenancy to end it for all. Nothing can stop that. This was reconfirmed by Leeds v Broadly a couple of years ago. If one joint tenant remains he becomes a trespasser unless the landlord/agent accepts his occupancy and demands rent, in which case a new periodic tenancy in his sole name would be created.
I strongly suggest you call Shelter for advice and if they confirm what Ive said, then if it were me, I would just leave at the end of the notice and leave them to discover their error.

They cant make the guarantor pay for something that they would have no right to claim from you. I would suggest you explain to your guarantor whats happening though and let them know uouve taken legal advice from Shelter and CAB. You might also want to write formally to the agent confirming that youve now had the same advice from a number of sources including Shelter and CAB and suggesting they take legal advice of their own. I would also add that any attempt to claim money under false pretences from your guarantor will result in a formal complaint to their redress scheme and potentially to legal action from you.
If you serve notice on a joint tenancy you serve for everyone. If they don’t move out it is as if none of you moved out. If they want to stay they need to get a new agreement.
Thats only true of a landlords notice lucinda5. As things stand, a valid tenants notice ends the tenancy. Any tenant who doesnt move out becomes a tresspasser. Any tenant who does move out has no further liability.
