Are tenants liable for rent after causing disputes

I have a hmo and finally filled my last two rooms.

3 days later one tenant posted in a group chat not to take clothes out of the washing machine otherwise they would face her consequences.

I quickly replied to not talk to tenants that way and refrazed it. Another tenant said put a timer on your phone. But then the first tenant started being personal calling her horrid names and a 3rd tenant joined in.

I deleted the group chat.

Police came but cautioned the one being bullied. After they left she took revenge and put the washing machine on pause. 2 tenants gone back to police making false allegations.

The two are now leaving and have stated in 2 weeks. I have told them they are both liable for the months rent up to the date they moved in.

They trying say they are the victims. 3rd tenant has given a month’s notice and the 2 new tenants want to move out after 2 weeks :see_no_evil_monkey:

Am I right they are liable until the day before their rent payment date? They say no. They caused this.

Can I put a ccj on them for the small ammount?

Erm check what your tenancy agreement says.

And..the reasons any of them want to leave or who is a victim and who is a bully are nothing to do with you and not your problem especially. You have a business agreement. They have to give the correct notice so if tenancy agreement says, for example, at least a month’s notice to end of the final day of a rental period, that’s what they will owe. Point them to whatever it says in TA.

Claim it from the security deposit as rent arrears if they don’t pay it

Thats exactly what ive told them. Thier home their arguement. I was not involved and wont get involved.

Whatever happend has nothing to do with the rental contract and it clearly states one clear rental month leaving the day before the rent is due the following month when they moved in.

If they leave without paying can I claim it, council did not pay a deposit for them.

Obviously I have learned to make sure they pay a deposit now.

The council say its nothing to do with them even though I had to sign them up for a 12month contract with the council as they refused to do 6 months. They have only been in for 8 months and 10months

In theory you can pursue any tenants for rent arrears however if they are unable to pay they may get put on a ‘payment plan’ lasting a long time plus you’d have upfront costs taking them to court so for 2 weeks unpaid rent may be better to cut your losses and be pleased you’ve got rid of 2 difficult tenants relatively easily

You mean these tenants came from the council list ?

Many on here would recommend against taking tenants introduced by the council. These are people that have been unable to secure a private tenancy. Did you advertise externally for private tenants? was this your only option? If so, you need to consider whether this is the type of tenant you want to have in the future or whether you could upgrade your property to be more attractive to others, or whether you’re best just to sell up.

And finally, you chose not to take a deposit, so knew that if they were a poor Tenant you would probably be out of pocket.

Firstly I have a few tenants from the council homeless and have had no issues with any other tenant. These 3 are out of 12 tenants.

I have my eyes wide open now thats how we learn.

I have had employed tenants just as bad.

I insist on deposits now.

A little bit of give and take is a good thing, we learn off each other, also answers to questions are often needed in order to gain the full picture.

Assuming they all have individual tenancies, their notice must be at least a month and end on the last day of a tenancy period unless your tenancy agreement says otherwise. Rent is due until the same day.

I wouldn’t operate a group chat as you, as controller have some liability for the messages people post.

I can understand why you did though. It’s helpful to have a way to communicate with all tenants at once. Consider setting up a WhatsApp group where you as admin are the only one who can post. That way, you can let everyone know info at once (e.g. that trades are coming round) but anyone can reply privately to you if needed.
