Hoping someone can advise on this, would appreciate it.
So tenants legal rep have drafted up a consent order as I am considering closing my possession claim with them (long story).
However the wording is as follows:
IT IS ORDERED THAT
1 The Claimant’s claim for possession be dismissed.
2 Defendant’s counterclaim be dismissed.
3 That there be no order for costs save for public funding assessment of the Defendant’s legal aid costs.
I did mention to the tenant i would consider closing my claim IF no costs are passed onto me. Points 1 and 2 is clear. However point 3 i am unclear on. Is this directed at the tenant or does this mean costs they have claimed for legal aid can be passed onto me.
Another question is if i do go ahead and agree to this consent order, does that mean i have allowed the rent arrears and can not pursue this via small claims etc…
