I want to hand my notice in today (2nd of Aug) and move out at the end of my fixed term (3rd of Sep). So surely I am only liable for rent payments till 3rd of Sep? A copy of my contract is below.
"The Tenancy shall be from and including the 4TH DAY OF OCTOBER 2020 (‘the Commencement Date’) to and
including the 3RD DAY OF SEPTEMBER 2021 and thereafter from month-to-month and until terminated by either
party serving a notice on the other in accordance with this Agreement (‘the Expiration Date’), ‘theTerm’.
“At the end of the initial fixed term as specified in clause 2 hereof, the Term shall continue on a month-by-
month basis until either party shall serve on the other a written notice to bring the same to an end. Such
notice, when served by the Landlord, should expire not less than two months after the same shall have
been served on the Tenant. In the case of a notice served by the Tenant, such notice should expire no
less than one month after service of the same on the Landlord”
Email from landlord says the following:
“In your contract terms, you need to give 2 months notice from 3rd August 2021 for your contract to end 3rd October 2021. I am afraid you are still liable for the rent until 3rd October 2021”
Just write to your landlord with his contract and ask him to take legal advice if he does not understand what he asked you to sign

It is normally the case with Contractual Periodic Tenancies that notice can be served during the initial term/fixed term, but your contract doesn’t seem to give that right. This is a pretty technical area of the law as the rules governing CPTs are still mainly found in case law and common law, not the Housing Acts. You would need specialist legal advice on this issue. You should call Shelter helpline in the first instance, but you may need to also speak to a housing lawyer. They should give you a free phone call in the first instance.
