Why don’t they fine councils for waste money for this behaviour!
because it is easier to fine landlords and make their life harder
This has been circulating for a while https://www.property118.com/best-practice-letter-template-go-eviction-notices/ , but who cares about an ombudsman? The fine is nothing compared to the cost of housing a family for six months. Until it is a law or a court rule - it is nothing.
And I don’t think targeting the advice itself is a good angle anyway. It would be difficult to prove such an advice has been given as it would most likely be verbal. What should be targeted though is when councill treats leaving after s21 as intentional homelessness. This should be challenged in court and I think it is a 100% win situation. But it is UC claimants who should be doing that and most of them seem to be just fine with the situation as it is, not understanding how hurting the landlords backfires at everyone, not just them nationwide.
I can definitely identify Lambeth Council as one offender in this regard. After nearly 6 months’ notice to the Council and now 5 to the tenant I have been forced to instruct a solicitor. I need the flat for my own son who has recently become homeless through no fault of his own and the tenant has informed me that he was told by Lambeth Council that they would do nothing to help him until a Court Order was created. This is a very pleasant family man from Serbia with five small children who has until now been a model tenant. Lambeth want to put him through the trauma of being evicted by bailiffs rather than rehouse him. Landlords appear to have no rights whatsoever; this is going to cost me thousands and meanwhile my son is sofa surfing, unable to accommodate his three children and suffering deep depression. They never reply to my emails or phone calls. It is disgusting that a so-called responsible council can treat people like this. I would never rent out another property again; this sort of treatment will ensure that fewer and fewer people will consider becoming landlords and fewer rentals will be available.
That is why I always say you cannot trust the Local authorities
Councils are hopeless, staffed by hapless People, so nothing will change.
quite right Rob .In fact it will get worse I have seen this the last 40 years of being a landlord so I started to rent out commercial places instead Less hassle from council. all pay no business rates as all get small business rate relief. Win Win … so far!!
My Ex Dil has just been through this, Wiltshire Council made her stay six months over her sec 21 expired. Her LL had no choice other than to apply to the courts for possession. Court delays dragged it out also. She was constantly threatened with being placed in temp accommodation miles away from her friends and the children’s schools. As an an only child and no family. We had stood as guarantors for her with private renting until we retired. The stress her and the children endured was criminal
This is the problem. Sometimes people only think of a Landlords suffering in such scenarios but the tenant suffers equally if they are decent people who would rather not be put in such a position, that goes against their morals.
