​"The landlord of 22 27 Sheldon Square W26DW is accusing the tenant of breaching the contract and acting like the victim, when she was actually the first one to break the law. For three years, she failed to register the security deposit, which I only discovered recently. Having rent arrears does not excuse a landlord from their legal obligations. She has shown a complete lack of respect for housing laws and tenant rights.“Do not be fooled: this landlord portrays herself as a victim while ignoring her own legal duties. She failed to protect the deposit for over 3 years, a major breach of the law. Regardless of any rent disputes, a landlord must follow the rules, and she simply doesn’t. Unreliable and dishonest.”

are you the person who is in rent arrears ? The one in rent arrears does not want to follow the rules /?

Do not be fooled this tenant portrays herself as a victim whilst ignoring her own legal duties.

Regardless of any deposit disputes a tenant must uphold the contract and pay the rent . If not it’s a complete disregard of housing and contract laws.

Unreliable and dishonest.

@Marcello as others have said one wrong doesn’t make a right, tenant shouldn’t be in rent arrears or breaching tenancy nor should deposit be unprotected by LL.

Tenant is in a strong position if they go to court (Google ‘Tenancy deposit protection ‘ for the gov uk page)

“If the court finds your landlord has not protected your deposit, it can order them to either:

  • repay it to you

  • pay it into a TDP scheme’s bank account within 14 days

The court may also order the landlord to pay you up to 3 times the deposit within 14 days of making the order.

..

The court may decide that you will not have to leave the property when the tenancy ends if your landlord has not used a TDP scheme when they should have.”

@Colin3 except s21s may not be allowed in this situation so more difficult… may be an s21 which has prompted this
