Do I need to provide two check out reports to Reposit

I rented out my property to a couple and one of them gave notice and left in March. The other person remained in the property for a further week without a new tenancy agreement before leaving. The additional weeks rent remains unpaid. I arranged for a checkout inspection when the first tenant left and again after the second person left. If I wish to claim for unpaid rent and damages through Reposit is it sufficient to provide the final check out report or do I have to provide both? If I only need to provide one, I don’t want to confuse matters by supplying both.

If the first person left at the end of their correct notice period, then the tenancy agreement ended for both at that time. Hence, the first check out report would be appropriate.

The 2nd tenant, it appears you have allowed them to stay in the property with your agreement, so you would have started a new non-documented tenancy with them for the 1 week period. You didn’t take a deposit (or a new Reposit) for this new tenancy, so your 2nd check out report is irrelevant. Any unpaid rent for this week is also irrelevant to the earlier terminated tenancy, so I would say you cant claim on Reposit for that.

In which case, the 2nd inventory is appropriate, as they stayed as a trespasser, and all rent until they left and damages to the 2nd inspection are appropriate. Both tenants are liable for this.. even the one who did leave.

What evidence do you have that you did not permit their stay? Do you have anything in writing telling them they were trespassing and must leave and that you could not accept rent from them? If you asked them about rent or they paid it, then you effectively permitted their stay. Doing a second checkout report may be construed as accepting they were still a tenant.
