My tenant has a guarantor, checked though open rent services and is on the contract.
The first year has recently ended and I let the tenancy go to a rolling contract. The guarantor has written to me requesting he be taken off the contract since he feels he only signed for a 1 year tenancy. Where do I stand legally, I’m pretty sure he can’t duck out now but how to respond?
Send guarantor a copy of the contract explaining that nowhere does it say they only signed for 12 months, and that any amendments to the contract have to be agreed by all parties including yourself.
If you have RGI you may well be able to say you obtained this through having a guarantor and wouldn’t have offered the tenancy without a guarantor
(I’d be concerned that guarantor no longer wishes to support the tenant- they might know of a change in tenant 's financial circumstances.)
Tell guarantor that if tenant gives notice and moves out then at that point guarantor obligations end (assuming tenant not in arrears)
