Can I change the fixed 6 month period to 4 months, given the difficult tenant I have - the new ATS is not signed yet but due to begin next week? The 3 housemates are all sensible tenants so I would keep them.
I believe there’s a statutory law that requires an ast to be for a minimum of 6 months. You cannot serve a s21 after 4 months.
An AST can be for any length. One day if you wish, but theres little point as a section 21 cant be served until the 5th month. However, you cant just change a contract that youve already offered to the tenants without their consent. If you have a difficult tenant, why are you offering a new contract? Why havent you let it go periodic?
