Joint to Sole request - End of 12 months AST

Hi,
My main tenant (Mrs) advised her husband moved out shortly after they moved into my property a year ago hence she lives at the property her children. She requested I removed his name from the tenancy then which I refused as only 1 month into the AST.

The 12 months is now due and she’s asked to sign a new tenancy and remove her husband’s name from the tenancy. I initially stated no benefit hence the husband helping to secure the property as she’s on benefit. She has paid the rent since the husband moved out 11 months ago.

Is it okay to grant a new AST 12 months in her sole name or leave it as joint (knowing the partner has moved out)?

Any advice will be appreciated as due now.

You can decline and just let the tenancy go periodic. The terms will be the same as the fixed term. This keeps the husband on the hook if she defaults.

It sounds to me as though his name was only on the contract to secure the tenancy and he had no intention of living there. He may never have moved in.

If you think you might need to evict, then I would do it soon as s21 will be banned in a few months.

Thank you for your response. I may agree that he never moved in only to help her secure the property as he is a high earner. However she has been paying her rent from her income (benefit) and has been a good payer.

In fact she has signified she would like to stay at the property on a long term, about 5 years, and promised to pay rent and look after the property.
