Hello. I have been in this studio for 12 years and have always paid rent for many years. I have a disability file and mental health problems. My rent is being paid. Now the landlord has obtained an eviction order using S 21 under the pretext of building a flat. But a month has passed since the eviction date. Now I have received a bailiff eviction order. Do I have any choice but to wait a few months? And is this eviction order legal?
LL can issue S21 for no reason so the ‘pretext’ is irrelevant.
If you’ve received an eviction order from bailiffs, it will be legal as the LL would have had to go to court to obtain it. The date on that order will be the final date you can stay in the property as bailiff’s job is to remove you from the property on that date. You should have had at least 2 weeks’ warning.
You can complete a N244 form to request that the court suspend the eviction order. Check Shelter’s website for details on this. It may not succeed but it might buy you time. Ultimately though, I think you should have been looking for somewhere else months and months ago when the S21 was first served. The Council’s homeless team might be able to help.
