Apologies David I see how my post could be misleading but going off a majority of the replies to my original question whether the landlords actions where legal the response seems to be he was well within his rights. These replies seem to be very judgmental against myself when in fact it is a retaliation by the landlord due to a report being made to the local council housing inspector regarding damp, mould and rising damp which is majorly affecting my sons and husbands asthma
That advice is legally incorrect and a local authority has now been successfully sued for giving such advice
Heās served a s8
A S21, no fault eviction, is classed as a retaliatory eviction
A s8 means heās got to have a legitimate reason to evict
The local authority are obliged to house you with a s21 as that it is not through fault of your own unless landlord says otherwise
Them not housing you where there is a s8 is a red flag for you as a tenant ā¦
Abolition of s21 ( to come in shortly ) is to stop local authorities being obliged to house you if you are served a s21 as itās costing them too much money
This story doesnāt stack up
In light of the councils advice to you heās well within his right to sue the local authority
You will have to be housed
Looks like the LA donāt want to house you
My advice to you is keep your relationship with your landlord amicable because you are going to need a reference to move in in the private sector
well i give up. Iām being given different advice .
Thank you to the helpful people who have replied but I donāt wish anymore replies. My health is suffering now with the stress and worry and the nasty replies.
It is a section 8 which has been issued as breach of contract - having a pet ( which was agreed at the beginning with agent), changing a lock due to lost key ( which agent was informed of )It was issued following the report i made and the inspection.
The agent is no longer managing this property, i received a text from her advising of this and heard nothing from the actual landlord since. I donāt even know his name just his business name.
The name of the landlord and his details should be on the contract
You can ask agent for his details
You can go online and get on to the land registry to get his details name and address
You can contact environmental health ref mould and they can contact the landlord on your behalf
contract has business address on agents name as landlord, which she advertised as landlord on openrent, i found out that she wasnāt the owner via land registry. Mould etc already reported and investigated - report advising of required works/repairs issued to landlord
Leave it to environmental health if they are speaking to the landlord
You can go round to his address and get number and email
The agent should share his data with you
