My tenant is 2 month in arrears. I want to give a section 8 notice based on ground 10. My question is can i give 2 weeks or 4 weeks notice. Some online source advice to give minimum of 2 weeks while others to gove 4 weeks. I read online that the 4 weeks notice has been changed this year will be in force on 1 may 2026. My question is, is the 4 weeks minimum notice already in use now or can I still use the 2 weeks notice? I prefer to give 2 weeks notice but i wan to be sure so i dont invalidate the notice.
You probably won’t get a judge to award you possession just based on ground 10. Its a discretionary ground and its usually best to use ground 8 in conjunction with 10 and 11 if they apply. With 2 months arrears you should be able to use ground 8. Any reason you’re not using s21?
