My tenant is being deported. But it is before either of us can give one month’s notice.
Further, she can not pay me 2 months of rent due to her bank account being frozen.
How can I terminate the contract so I can open it up again for rent and how do I ensure that I get to keep all the deposit to reclaim at least one of those months of rent?
Did you do a right to rent check before the tenancy began? Did the tenant have a time limited right to rent and if so did you follow up with another right to rent check approaching the end date? I would take it that the deportation ends the tenancy. Take copies of any deportation paperwork to show to the Council and utility companies as she is likely to be in debt with them also. Arrange to collect the keys and start looking for a new tenant.
You can accept a short notice to quit if the tenant serves one. Accept in writing. Ask the tenant to agree that you can have the deposit when you claim it on the scheme’s website.
