Prospective tenant has said she doesn’t want her partner on the tenancy agreement as she will be responsible for the rent etc. I have just googled Permitted Occupier and this will still be able to be used after May 1st but advice is to put the person on the tenancy agreement as a permitted Occupier. Can this be done by OpenRent when setting up the tenancy agreement or should there be another PO agreement?
OR won’t do it and advise all adult occupiers be named as tenants but you can add a custom clause setting out their status (and that it ends with end of the tenancy agreement). Someone here may have a suitable example clause or ask a lawyer.
Basically both will be living there and responsible for maintaining the place and behaving in a tenant like way even if only one will pay. Both will need to be on council tax bill. Both will cause wear n tear. Both need to be considerate of neighbours and to report problems to you promptly etc Etc. Better to have both named as tenants and do checks on both. If that’s a problem for them find someone else
