I have moved out of a rental before the end of the tenancy, i gave plenty of notice and am still paying the rent and council tax. The landlord has raised a dispute regarding the garden for the full amount of the deposit, which i am objecting to. My question is I have reason to believe that he has moved another tenant in, can he do this with a dispute still ongoing and should he return some rent to me ?
A landlord cant charge 2 sets of tenants for same property so yes they would potentially need to return some rent to you. They are able to charge you reasonable costs they incur due to you ending tenancy early.
A dispute on deposit is separate and it is fine for landlord to move new tenants in whilst a dispute is resolved.
