Possession Order Costs
I’ve searched and can’t find anything definitive.
Served section 21, have extended section 21 at tenant request but now need a possession date.
Tenant been told by council and Shelter not to move (as no council properties) so I’ll need to apply for possession order.

  1. Can I write to tenant saying if I have to go for possession order, I will charge them the possession order costs?
    2. Are these costs something I could take from deposit?

You have to be awarded costs by a judge. With s21 under the accelerated procedure, you would normally have to sue for costs afterwards. However, this is standard practice from Councils and the tenants may have no choice. Many landlords hust absorb these costs now.

Ring your deposit scheme and ask them.
