Premium council tax

My last tenant left in Feb 25 told me use his deposit as rent! Stress me out then told council tax he left in Feb 24 and now they doubled my tax to premium! I have to now prove occupancy. He paying me rent until dec 24 so I sent council receipts tenancy agreement but they saying this does not prove occupancy. Can anyone help me with ideas?

Did he not give you any form of written notice to leave?

Do you have any photos from inspections showing his property was furnished during the period in question.

Why are they doubling your tax ?

Because the property has allegedly been empty & unoccupied for over 12 months I suspect. Landlord now has to prove it hasn’t, and the AST only proves the tenant is responsible for the property, it doesn’t prove they were actually living there.

What correspondence do you have between you and the tenant ?

This is exactly correct I rented house to him as agent to get permission to convert into hmo. While he applied for this he had many different pp occupying rooms some he divided into two rooms. He dealt with application for hmo and saucing tenants getting tenancy agreement while his application was being processed by council. And continued to pay me rent from
June 23 to dec 24. So although he didn’t live at property he was authorised by me to sublet while his application was being processed. Which is allowed. Come November council refused to give me occupancy he wanted so decided to stop paying rent from Jan 25 and slowly got existing tenants to leave. Eventually he left on 13 Feb 25. Now I need to prove he lived at my house ! Which technically he didn’t .

I had inventory check and check out done would this help you think?

why not ask the council if it would help?

They don’t give advice simply tell you upload evidence on portal. Anyway I send them inventory. But I need utility bill in his name to show he receiving supply. But this is against gdpr rules. So difficult to do this.

Is there not a clause in your contract allowing you to share tenant data with whomsoever necessary ?

or ideally, in the data protection notice that you asked him to sign when you took his ID way back at the start of the process?

This is impossible to obtain without the tenant’s permission. It’s illegal to open post and you would not have access to any recent utility bills. I can’t see how the council can require this of you. Doesn’t sound right to me.

In addition, you just told us that the council don’t give advice (presumably on what documentation to provide) but you’ve also told us that they asked for a utility bill. Again, this doesn’t sound right to me.

You have to tell the utility company who is using their product.. L A can be told also after all you want to tell them who pays the council tax , hence show the proof.

Bills are due in July
Is there no correspondence at the address
Leave it a few weeks Mail will come in his name

and opening it would be illegal so I’m not sure how it’ll help the OP

Guessing to send utility bill they not told me anything just to upload what documents to support it was occupied. I am now also selling house as this is all too much. Tenant allowed me in Jan 25 for estate agent to come to house to photograph it. It was divided when they went to value and photograph it. I will ask them to get access to those pic it also had floor plan. My council tax now if ÂŁ550 a month!

100s of parking tickets Hmrc letters and demand for payment. Addressed to all pp that lived there. I send them back with rts. Even tv licence are demanding access as they think TV is being chased estate agent is hunters and they washed their hands all they sent me letter in Jan to confirm he was leaving in Feb 25 which I uploaded to council but this is not enough to establish occupancy.
