I hope that I am in the right forum here for just landlords. Assuming that I allow the shade to be built, what problems or any nasty surprises might I expect from this, and would I be expected to have some form of involvement to this, i.e with the council, and what, if any legal issues might I have with this? I really appreciate to hear your thoughts. I personally have no problems with the tenant erecting a compliant shede, haven promised to restore to original state when they leave the property. I see it as a pro that will make the house clean and tidy rather than storing bikes, lawn mower etc. in the house. But I might have some blind spots hence I am asking. Thanks for your thoughts.
Who will own the shed at the end of tennancy if the tenant is planning on leaving it are they expecting some financial renumeration?
These thi gs need to be ironed out also os it going to be concreted down as this may class it as a permanent fuxture and need planning permission
I have a shed 11 metres wide and 3 m deep which needed careful planning to stay within rules, and a foundation being dug out. So a shed is not a shed, you need to be more specific.
David 122, just seeking suggestions and what people think of the idea. I believe people on this forum are experienced and knowlegeable, and i will have to weight things and make informed decision.
Gary, the prospective tenant said that he will restore the garden to its original state at the end of tenancy. This is verbal yet though, and if he passes referencing and we do proceed with the idea, i would like it put in the tenancy agreement to cover myself for liability. I am wondering requesting more than one month’s deposit for the cost just in case he backs down and i find myself having to pull it down myself.
Gary, on the question of ownership. I would assume that the tenant owns the shed just as long as he continues to live in the property, just as his belongings. But I would like to look inside the shed during inspections to ensure nothing sinister is going on. But what if the shed is under lock and key? I could specify in the contract that the tenant must allow inspection of the shed on the inspection days. I would want to have a copy of the key but that might not be reasonale being their belonging. I fear problem might arise if he denies access, and what can i do in that situation? What do people think. Thanks.
So part of the agreement should state “periodic inspection of any outbuilding or shed would need to be agreed upon BEFORE the landlord gives permission for any such item to be erected”
Then when you arrange with the tenant to do the periodic inspection of the property confirm with them that you want to have a quick check of the shed to be honest the 1st check would probably be the last you MAY find that once you check it it is full of kids garden toys and garden furniture and there is no room for anything untoward etc
I dont think you need to hold a key (especially as YOU state that the tenant would own the shed)
Thank you Gary. Only that among the kid’s garden toys would be motorcycles or just motorcycles. The tenant has said that he wants to use the shed to store motorcycles that he buys and sells. So basically like a warehouse I would think. So i would expect to find motorcycles perhaps other things. I don’t know, am i naive to think that storing motorcycles for business in a residential property would not pose any risks or problems to the property. Any body with experience in this area?
I know some people who run a business from a shed in their garden. Eg hairdressing, dog grooming , nails .or as an office. Not in my rentals but when I sell them building products . So this is not uncommon. How you go on to monitor it is up to you
Also, are you ok with him running a business from your premises? Is everything above board with that? Is both yours AND his insurance aware that a business is going to be run from the premises.
And that vehicles with fuel in them (and possibly other recepticles)with oil,fuel who knows what else is used in the selling of motorcycles)
Have you considered the impact on any neighbours as there will likely be motorcycle engines revving and being tested possibly driven up and down i know i wouldnt like to live around that let alone next door to
