Renting deceased in laws property

Hi All.
New to the forum. Apologies if this is not the correct forum.

Bit of a complicated dilemma that I hope I can get some guidance on.
I currently rent a first floor flat ( for which I claim housing benefit) which, due to disability has become extremely unsuitable and I need to move.
In the meantime, my ex mother has passed away, naming me as the sole executor of her estate and her two children as joint beneficiaries.

The main part of her estate is a bungalow, which, so far we have been unsuccessful in selling due to it’s poor condition.

My question is, can I legally rent the property for myself ( with the agreement of the beneficiaries) and continue to claim housing benefit as it is far more suitable for my needs , even though I’m acting as executor of the estate ? Obviously any rent will be either paid to the beneficiaries, or form part of the estate when it’s eventually sold.

Sorry it’s so long winded but any advice prior to seeking legal advice would be grateful As it’s a bit of a minefield.

I think that the answer is yes, but if you have a contact at DWP, I would run it by them first to make sure theyll pay up. There may also be some issues in letting the property before probate is settled, but youd need a solicitor to deal with that one. Id also suggest you get the written agreement of the beneficiaries about the rent you should pay so that there is no comeback later.

Thanks for the quick reply. What you say makes sense. Much appreciated.

As above id run it passed HB 1st as they may not cover the full rent and you maybe liable for the shortfall check on the website of the local council where bungalow is that will tell you how much they pay
