Rogue landlord goes to small claims court

Hi there,

Our ex landlord refused to return our deposit which was lodged with mydeposit. He made a series of false allegations and filed for these claims through small claims court. We countered all of the claims, submitted defence and also counterclaimed.

It has been more than 2 months since the counterclaim was submitted but there’s been no response from court. Please advise what should be done.

Thanks, given that we haven’t received a defence or acknowledgement of service for the counterclaim, can we ask the court to pass judgement?

I do not know the answer as I have never had to go to court. But if they have not looked at your case , how can they pass a judgement?

Call the County Court who will be dealing with the claim.

I just googled and it says;

How long does a claimant have to respond to a counterclaim?

within 14 days

A Defence to Counterclaim must be filed and served within 14 days of service of any Counterclaim otherwise the Defendant may be able to obtain judgment in default against the Claimant.
