Tenant Leftover Belongings at Property

Hi

If a tenant leaves belongings at a property after moving out (they have terminated the tenancy agreement), as landlord do we have any obligations regards disposing of the leftover belongings?

Can we just employ a house clearance to get rid of everything?

Can we sell anything of value to cover rent arrears?

Nope you have to store it for at least 2weeks and send a letter , you can charge for storage

You need to follow whatever provision is in your tenancy agreement for goods left at the property. If there is nothing then its usually a month, unless the tenants owe you money. You have to make multiple stringent efforts to return the items to the tenant before you would be allowed to dispose of them or you could fall foul of the Interference with Goods Act.

If the tenant confirms to us via email that he wishes for us to get rid of the leftover belongings, would this be sufficient for us to proceed in doing so? He has said as such via text message but we don’t want to rely on a text message.

Yes, I would think so. I think probably even the text message is reasonable evidence.
