My question is, my landlord will be served a prohibition order, with 2month scale. (From environmental health) When will I be sent the details, do the council have to re house me immediately or will I have to wait the 2month, do I still pay the rent as I have been even tho I’ve lost clothes shoes toys beds to the damp and mould? I’ve never had this before n I have younger children. And support or advice would be great thanks
sorry to hear about your difficulties
ask Shelter or Citizens Advice who are more likely to know and be able to help you as exactly how it works may be different in every Council. Check your tenancy agreement as well to see if LL has obligations.
Re damp and mould there are very good advice guides online on how to avoid it, eg google ’ Condensation, damp and mould’ by Centre for Sustainable Energy.
You should get legal advice before deciding to stop paying rent, if you do that you could be evicted for rent arrears.
good luck
You’ll need to continue to pay rent. If the landlord does not comply with the prohibition order, you’ll be able to apply for a rent repayment order to get the rent back. Talk to Citzen’s Advice about this. You can read more on Shelter’s website.
Thank you for your advise, I was planning to pay anyway as I don’t want to be in arreers and that affect me gaining another place to live, but also it’s more that I’m having to replace 3 mattresses a set of bunk beds and a single frame plus all the other items we’ve had to throw. I’ll speak to CAB as I’d definitely like confirmation of the best way to approach this situation. Thanks again for the input x
