Tenant stopped paying rent

Hi any advice, my tenant is 2 weeks late with rent. I rang him and asked about the rent andp to do an inspection but he informed me I couldn’t as he is at Preston crown court all week awaiting sentence.

He moved a woman into the property without my knowledge or consent, who he calls his partner.

He said he has been sanctioned by benefits so unable to pay anything, so I’ll just have to wait for the rent.

I am angry about his attitude and want to serve a section 21 notice what do u think, he is only one named on a assured tenancy agreement

I would serve a section 21 immediately while it is still available. When the Renters Rights Bill comes in you would have to wait until the tenant is 3 months in arrears before you can start eviction proceedings. Before serving it, double check that everything was in place (gas safety, deposit info etc) to make the tenancy compliant. You should consider seeking help from an eviction specialist if you are unsure.

Assuming that you can serve a valid s21 notice at this point, then I would also go ahead with that now.

@rob25 if you have rent gtee insurance, check if it covers this situation ; check your landlord insurance if you have it to see if it covers costs of serving notices, and legal etc costs of eviction - sorry if obvious
