Tenant using deposit to pay rent

Hi my tenant decided not to pay rent and used deposit to cover last month. Now he moved out he left me professional clean including oven and jetwash and clear weeds in garden. I paid hunters my agent for check in inventory and rent/legal cover insurance policy. Where they have insurance in their name with me as interested party. I have asked for claim ref for none payment of last month and I would use 5 week deposit that I kept and registered when he moved in to deep clean house. Hunters have advised me I need to pay for check out inventory but is refusing to make a claim on insurance. These are two different matters. The tenant is now claiming he wants his deposit if I want my rent. Hunters have said they won’t claim without a check out inventory due to conflict of interest which is a load of bull. I can use deposit due to none payment of rent but I need to pay for cleaning. He is infact in arrears to even cover one month rent from deposit any help I appreciate Mrs kalpna shah

Tell the tenant that you are prepared to sue them in court and ensure they get a CCJ if they dont stop messing around and pay their rent. You can let them know that there will be deductions from their deposit for hhe yhings you mention.

I wouldn’t normally jump in to support a letting agent but in this situation they make a fair point. You will need to provide evidence to make a claim on the tenants deposit and or insurance policy. You will need some photographic evidence to show the condition the tenant left the property in. The problem is the cost of both check in and out inventory is more than the deep clean. In your situation I would claim the rent arrears from the deposit and take the hit on the cleaning and move on.

Thank you for fb I decided to get check out inventory done now as changing locks has cost me £300 in London and she do all work of before and after. I advise all landlord to get inventory. So we claim rent and tenant can dispute his deposit direct with them as I registered it and I will respond to his claim. Once all cleaning gardening is done he ca. have what’s left as long as insurance give me my rent.
