Tenants split up, non-main-depositer wants to stay

Our tenants split up this week. One wants to stay but it’s not the main deposit holder, they’re listed as the additional tenant.

Two questions:

  • Do I release the whole deposit and request a new one from the remaining tenant?
  • Can we renew the tenancy to reflect this change, with neither party activating any break clause? Just immediately make and sign a new one?

Can the other tenant afford the rent on their own? I would suggest you re-reference and credit check them.

You dont have to do anything. The tenancy would still continue and both tenants would be liable whether living there or not. If one of them subsequently serves you a valid notice, it would end the tenancy for both and you can then decide whether to grant a tenancy to just one of them or go out to advert.
