We let a house with two tenants. The current contract ends in September, at which point one tenant (A) is moving away and the other (B) wishes to remain. B has found a friend to share with, and I understand that we will need to set up a new tenancy agreement with B + friend, and my questions are: (1) can we run background checks on the friend prior to September rather than leaving it to then? (2) can we in fact get the checks done and the contract signed to start, before September? (3) is it fairly easy to sort out returning one deposit, retaining the other, and collecting a new one too? Yes, you can do the referencing on this person at any time. I would be wary of signing any new TA until move-in day as Tenant A could change their mind at any point and put you in breach of contract.
You should bear in mind that this is a whole new tenancy, and you need to end the old one through a deed of surrender on the day he moves out and do a full check out inspection and refund the deposit less damages. The new tenancy needs to start immediately afterwards and have full new documents and if you wish a new deposit.
