Hello all - lovely joint tenants, unfortunately are splitting up after years in property. Hubby wants to leave property, but wife wants to stay on and find a flat mate. I assume I simply start a new lease with the wifes name and new tenants name ( after credit check on new tenant) - would it be as simple as that please. Obviously, also notify deposit protection company.
1stly im not and never have been a ll would you have to do a credit check on the wife to ensure she can.actually afford it (should it be a few months etc till new tenant) or you may run.into all sorts of trouble then i would expect a new TA to be drawn up in just the wifes name then another one once the new tenant is there
If you are confident that she and the new person will be able to afford it, (theyll need to be referenced), then you would end the existing tenancy with a deed of surrender on the same day you create a new tenancy for the wife and house-mate. Dont forget to do a checkout inspection and deal with the deposit.
