I have issued both S8 & 21 to tenant who is more than 2 months in arrears and been continually late with rent payments. If I progress with possession using S8 but she pays within 2 months, can I fall back on S21 if this becomes valid by time court date ?
Yes you can use either or both at court, but you should check the s21 is valid.
